In our view there is no question whatever as to our power to award costs, either for or against the Crown in such proceedings, but there is, and long has been, a well-set rule of practice that in criminal matters on appeal no: order as to costs is made unless in cases, happily rare, where the prosecution has been undertaken maliciously or oppressively.
