Lieut.-Col. Isham claimed as the assignee of Lord Talbot de Mala- hide, who succeeded to the "books and pictures in the House of Au- chinleck" under the testamentary writings of his

aunt, Boswell's great-granddaughter, Julia Boswell

Mounsey.

The unsuccessful claimants were Baron Clinton, owner of Fetter- cairn House, the oldest descendant william Forbes, Boswell's executor. in the direct line of the late Sir

Cumberledge, or Hatley, claiming who died in 1795, and Mrs. Mary

as descendant of one of. Borwell's younger children.

BOSWELL'S REQUEST

The dispute arose out of the terms of Boswell's will. Lord Stevenson came to the conclu- sion that Boswell's manuscripts and letter were at Auchinleek when he signed his will in Lon- don in May, 1785.

He said it was reasonable to in- fer that the codicil dated Decem- ber, 1785 was written because he desired such manuscripts as he had taken to London to be collected be- fore they fell into the hands of strangers.

Alexander Boswell, as the testa" tor's eldest son, was entitled to de- mand delivery of the papers from Sir William Forbes, who received them for the sole purpose of deter- mining which of them the literary trustees should" publish.

If Alexander had a right to de- mand delivery of the papers, that right transmitted to the widow of his son James, and in Lord Steven- son's opinion passed equally to her two daughters as part of the re- sidue of her estate.

Lady Talbot and Mrs. Mounsey shared this right between them. Lady Talbot's share passed under her marriage contract to her son. the present Lord Talbot, who had assigned his right thereto to Lieut. Col. Isham.

Mrs. Mounsey's share passed un-" der the residue clause of her will to Cumberland 'Infirmary.

Lord Stevenson therefore ranked Lieut.-Col. Isham and the Cumber- land Infirmary equally to the pro- perty. Meantime he adjourned the case to ascertain which of the do- cuments in dispute fell within the description "manuscript of what- ever kind lying in the house of Auchinleck.
