"Discipline on board the ship seemed to be practically nil. It may be all right under some flars but not under the Britlik Flag. It looks to be a very near mutiny and accused' seems to have carried that into actual fact not only by striking the Third Officer, with his fists, but later returning with a poker and attempting to attack him from behind," said the Hon. Cmdr. G. E. Hole, Harbour Master, in the Marine Court yesterday, when he passed sentence of 12 weeks' hard labour on IL Wakisita. Japanese quartermaster of the 1.3. Silkworth, who was found guilty of having assaulted A. Sanuki, third 'officer and fellow-countryman, on the morning of January 28. while the vessel was on a voyage from Hong Kong to the Philippines.
Giving' evidence, Saduki stated that on the morning of January 28, acting on the instructions of the Chief Officer. he asked ac- cused to clean the bridge.
Accused said that as he was not on duty, he would not take the "job and asked witness to go to the Chlef Engineer who would be able to report to the Chief. Officer re- garding the duties he had been engaged on that morning.
"Accused told me to go and see the Chief Engineer, the interpre- ter," said witness. "I told him to go himself. He insisted that I should go so I went to the Cap- tain and Chlef Officer and report- ed-the matter.
TOOK OUT REVOLVER "Accompanied by the Captain: and Chief Officer, I returned to the bridge where the quartermas- ter was waving a stlek which he held in his hand. The Captain took his revolver out, whereupon accused became quiet.

His Worship (impatiently): I have never heard evidence given so badly in my life. You're wast- ing my time and I am a busy man. When did the assault occur?- When the Captain came on the bridge at 9.20 a.m. accus- ed struck me with a stick in the presence of the Captain and Chief Officer."
Rebuking the witness, Els Wor- ship said: "First you said, you were only pushed, and then you stated you were hit with a stick. Evidently you are scared."
Captain John Jackson. master of the Silkworth, sald: On the day in question. the boatswain was ordered, in my presence, to wash down the deck. While the third officer was talking to the boatswain about the order, accus- ed entered into, conversation with the latter. Their discussion was in Japanese and I did not under- stand it.

The charge was brought against Chan Chun as a result of the death inquiry, at the conclusion» of which the jury ruled that he was responsible for the death of the deceased, who died from rup- ture of the spleen and fractured ribs.

Tim Kin, widow of the deceased, in evidence yesterday, said that she, was with her husband in the house, an unnumbered but in Cheung Sha Wan, about 2 pm. when Chan Fat, the owner of the sewing machine. the subject of the theft, came in with District Watchman 38, and assaulted her husband. She stated that the district watchman prodded, her husband, on the left and right sides of the body, and after wit- nessing that, she was ordered out at the cubicle. About an hour later her husband left the house, with the district watchman and another each holding him on a hand.
