Insurance policy was decided by Mr. Justice Lawrence in the King's Bench Division recently.
It was stated that the Commer- cial Union
Assurance Co. Ltd. Issued a policy whereby, in con- 31deration of the payment
£1,000, the company was to pay the policyholder £52. 5s half- yearly over a term of 11 years.
These payments were calculated so as to return to the policyholder over that period his £1,000 and Interest at the rate" of £2 10s per cent, per annum.
It was contended for the com- pany that ad valorem du'y under the Stamp Act, 1891, was payable. at the rate of 23 6d per £100, or fraction of £100, on the total amount secured. Alternatively, the duty was payable at the rate of 23 6d per £100 on £1,000,
The Commissioners, of Inland Revenue had decided that the policy was security for an annuity. and assessed it as if it were a [00 ct. conveyance' on sale, namely, at
10s per £50 on £1,000.
