Keen at the Central Magistracy on Saturday for the Larceny of a jewellery box con- taining $228 in Hong Kong money, $14.40 in Chinese money, a gold locket. a gold buckle, a gold Anger ring, two gold ear-rings and many other small articles from 30. Defendant, when questioned stated that he took them both at the same time and not at dif~ ferent times as the boy told the police.

Written Judgment Delivered

Judgment was given by Mr. E. Elmsworth at the Kowloon Magis- tracy on Saturday in the forged trade mark in which the Kam Pul Drug Co. was summoned by the China Dispensary.

His Worship said in part:---- In this action the defendants aro charged with three offences: sell- ing goods to which a forged trade mark has been applied; having in' their possession for sale certain goods to which a forged trade mark was applied; and exposing for sale certain goods, to wit thirteen bat- ties of Skin Lotion to which a forged trade mark was applied.

I will deal with the third charge Arst. Due probably to an over- sight on the part of the prosecu- tion there was never any evidence produced to show that thirteen bottles mentioned in that charge were ever exposed for sale. The first witness, who executed the warrant, did in fact seize the thir teen bottles mentioned in the charge but he was not called upon to give evidence as to whether they were or were not exposed for sale and in the absence of such evidence I do not think this charge can proceed further.

After dealing with the first two charges, in detail, his Worship sald that he held that the defendant had failed to substantiate a de- fence and that he must register a conviction on the first two charges.
