POSITION
At a press reception in the Minis- try of Justice; Dr. Guertner, Minis- ter of Justice, announced that the Commission appointed by Adolf Eltier in 1933 to revise the German Penal Code had now completed its 、arork.
The Chancellor's instructions to the Commission had been to create the German Penal Code anew in accordance with the newly gained fundamental views of the present Lime.
Interesting detalls of the new German Penal Code were made af- ter Dr. Guertner, Minister of Jus- tire, announced its completion at the press reception on Thursday.
A jurist speaking on the subject | *murder" and "manslaughter" an- nounced that "a murder under the new code is a person who kills another in a fit of homicidal pas- son for sexual reasons, out of greed or other ignoble motives, in a treacherous or cruel manner, or With a dangerous implement, or fa Preparation of another crime-All other cases of intentional killing are regarded as "manslaughter," and punishable by prison terms ranging from 5 years to life.
An innovation is made in the form of punishment for persona equipping themselves with danger- ous implements for committing murder. "The irresponsible en- dangering of human life", is also punishable. Suicide or siding and abetting another person to suicide is not punishable under the new code:

The MC.C. touring cricket team scored 328 for the loss of seven wickets at the close of the first day's play in their match against Victoria.
J. "Hardstaff (Notts) contributed 85 and C. J. Barnett (Gloucester) Knocked up 131.
Making his first appearance in the tour, Maurice Leyland (York- shire) scored 24. The M.C.C. lost three wickets for 98.
At lunch the total was 74 for 2, and at tea 208 for 3 (Bamett 107 not out).
The match will last four days. There were 7.500 spectators pre- sent when the match was started. The
weather was cool and the wicket fairly fast. The 200 was reached after 190 minutes' play end 300 in 273 minutes.

Himsworth at the Kowloon Magistracy yesterday for causing an obstruction by parking his car on the wrong side of the Roud for 25 of Saigon road minutes on October 20.
