Commander Hole continued that just as he was about to take the curve he heard another hoot from the car and out of the corner of his eye he saw a car drawing up abreast of his. He exclaimed "My God! He is going to pass me on the corner!"

"I then saw a big red bus com- Ing in the opposite, direction," sald Commander (Hole. "By this time the overtaking car was abreast of me and I had already" started to take the curve. I saw at once that unless something was done, and done at once, one of two things would happen: either that the overtaking car would crash head- on into the motor bus or else he would swerve to the left and pro- bably hit my bonnet, with the back of his car, thus forcing me into the ditch and possibly over the bank."
Commander Hole said he there- fore jammed on his brakes as hard as he could and the overtaking car came to the left clear of the oncoming bus and went on. After taking the corner and going on into the next straight, stretch, he took the number of the overtaking 'car.
On Tuesday, June 2, Commander Höle continued, he reported the matter to the police about 3.30
p.m.

her when she saw it. Mr. Piovanell wrote her a letter later. expressing regret at having upset her, she stated.

Mr. Piovanelit stated in evidence that he saw Commander Hole's car while travelling along a straight stretch of road, hooted twice and began to overtake it on a straight stretch but as soon as he drew level with the other car, it began to accelerate and kept levél with him for at least 30 yards.
"We were then approaching the bend," he said. "I could see a long way round the bend and noticed the bus approaching. I acceler- ated to about 40 miles an hour, overtook the other car and passed between it and the bus with the greatest of ease as far as I could see. The distance between us and the bus was about 15 or 20 yards.
