Tenant's Counter-Claim For Reduction Dismissed
Shanghal, May 6. The Second Branch Kiangsu High Court has reversed the Lower Court's decision by which a reduc tion in rent, by 20 per cent, for a period of two years, was granted to Tung Lai Yung Chi Hong, tenants of the China Realty Cem- pany, occupying property in Lane No. 520, North Soochow Road.,
The China Realty Company, re- presented by its lawyer, Dr. L. C. Yang, brought in action in the First District Court against four tenants occupying the company's property in North Soochow Road and North Shanse Road, to recover rentals in arrears. One of the ten- ants, the Tung Lai Yung Chi Hong. filed a counter-claim for a rent re- duction by 20 per cent. The Dis- trict Court gave judgment against all tenants, but, in the counter- claim of the sald Tung Lat Yung Chi Hong, the court granted a re- duction equal to 20 per cent, of the original rate for two years.
The China Realty Company was not satisfied and appealed against the decision with the result that the decision was reversed. In its written judgment, the High Court said that the Lower Court's decision granting reduction by 20 per cent. was not supported by evi- dences (N.C.D.N.).
