ASSAULT ON A

EUROPEAN LADY Around the Courts

Young Chinese Convicted

Ma Wong, a 20-year-old shop foul, who was charged with having assaulted Mrs. Grainger of No. 61.

at Jubilee Building, Shangbai Street, was uned $50 or in default two months hard labour by Mr. E. 1 Wynne-Fones at Kowloon Magistracy yesterday.

Mrs. Mary Elizabeth Graiger in the witness box, said that August 8 at about 10.30 a.m. the WIS walking along Shanghai Street in the Company of Mrs. Huxley and Mrs.. Coward. Katherine Archer, 14 years old and Nancy Huxley were walking behing them and her daughter, Joyce, 8 years of age and her little son. Denis, 34 years old were behind these two girls. Witness further stated that she carried her baby in her arms. Her son, Denis was carrying a sun-shade in one hand and in the other. he held a balloon, which was tied to a piece of string. Witness heard Denis scream and turning round saw a Chinese man holding his arm. Witness went back to where the Chinese and her son, were. just outside house No. 192 and asked the man why he was hold- ing her son's arm, and while "doing so, she held out her hand so as to cover her baby who was In the other arm. "The man then struck her with the back of his hand across the face.

Having given, the baby to the care of one of her fr.ends, witness- went to Nathan Road to get a policeman, but not one could be found. She met a traffe officer, but on going back to the scene, the man was nowhere to be seen. She then went to the Police Station to report the matter, and later, in the afternoon, witness. went there to identify defendant as the man who struck her.

Questioned by His Worship, wit- ness said that when she went to her son, she did not see any sweets

in his hand, nor was he eating any. There were no signs around her son's mouth that showed that he had been eating any.

The next witness called was Mrs. Elleen Huxley. She testified that she was with complainant” when the former went to her son, from whom, witness heard a silout. Witness could see distinctly the "mark of a hand on the boy's face, although she did not see defendant hitting him. Witness also saw de- fendant strike the last witness across the face with the back of his hand, and with a fist.

Speaking from the witness box, defendant said that on the day in question, he saw complainant's son stealing sweets, which were of coconut flavour. Witness was delivery coolie in the Yee Lan Sweet and bisculta shop at No. 192 Shanghai Street. The fokis of the shop were having their morning" meal when he saw the small boy take off the lid of the bottle.con- taining the sweets and take some of them. This bottle was placed on the doorway of the shop for sale. The lid of the bottle was made of brass and could be easily taken off, and at that time, the bottle was full of sweets, The small boy had taken 5 sweets and witness ran out to where the boy was and got the sweets back. The boy then cried and a European lady ran up to him; thinking that he had assaulted the boy. Fur- ther witness said, that on the contrary, complainant assaulted him, although it was with little force. Witness concluded by say- ing, that, after that he walked out. When questioned by the Magis trate, most of defendant's RESWETE were contradictory to his evidence.

Chap. Cheung, salesman in the shop where defendant worked and Tam Wing. accountant in the same concern, both gave evidence. The former sald he saw the son of complainant taking away the weets and defendant taking them back from him, but did not see any lady talking, to defend and about the boy stealing sweets from the ab th's told by defendant to him

Detective Sub-Inspector O'Dono van appeared for the prosecution. and stated that on Sunday the de- fendant was arresed on suspicion and when searched at the Central Station he tired to discard a bangle which was indentified as part of the haul the total amount of jewel- lery and money stolen was valued al $340.

De- tective Sergeant Allen stated that a man was seen with a gunny bag containing the brass and was ques- tioned. He stated that ke had bought it from defendant and took the police to the shop and pointed him out.

Shum Po-lam, 23-old-old unem- ployed. was yesterday, charged before Mr. W. Schofield, at the Central Mag'stracy, with unlaw- fully and maliciously setting fire to ashed with intent thereby to in- jure, at Ming Yuen Gardens, King's Road; сп August 10 Inspector Fender, prosecuting, applied for a week's formal remand. Mr. Scho- field granted the application.

Appearing on remand before Mr. Wynne-Jones at the Kowloon Ma- gistracy yesterday, Chlu Kel-shing. 23, unemployed, was fined $25, or In default, one month's hard 18- bour for stowing away on the steamer Hupeh from Amoy. Capt. Smart appeared as complainant and stated that defendant Wis found on board the ship after they had passed the port limits of Amoy,
