Damages For Pain And Suffering

An important ruling affecting victims of accidente was given by Mr. Justice Humphreys at Bir- mingham AssisOS.

He held that under the Law Reform Act passed last year the administrator of a dead person's estate. could recover damages for pain and suffering caused to the dead person during life.

The Judge added that it was obviously a case which should be considered by the Court of Appeal. When moving the second reading of the bill in Parliament in June, the Solicitor-General explained that it provided that the right of action was preserved after, the rieath of an injured person.

Referring to counsel's argument that while in the case the damages could not be very large owing to the fact that the girl only lived four days after the accident, Mr. Justice Humphreys said a case might arise where a person had been grievously injured and lived for months in pain and suffering, and then died.
