RECALLED

Allegations Of Intimidation Against Police

"In the course of a murder trial which came before the Chlef Justice yesterday, the defence submitted that a statement made, by the accused person at the No. 2 Police Station could not be admitted as evidence. because intimidation had been used against- the accused person before the statement was obtained.

At the close of the case for the Crown, the accused person. gave evidence on the point of intimidation alone, and after hear- Ing him, the Chief Justice, His Honour, Mr. A. D. A. MacGregor, ruled that he was satisfied that no intimidation was used and Jurther that there was no deglect of the formalities which should have been observed by a responsible police officer,

ACCUSED IN WITNESS BOX

"Mr. J. A. Fraser, Assistant At- tomey General, appeared for the Crown, while Mr. H. C. Macnamara, instructed by Mr. J. M. Hall, of Messrs. Lyson and Hall, appeared for the defence.

The Case Outlined Mr. Fraser said the victim of the killing was an assistant of the accused at a hawkers' stal in D'Aguitar Street. On Sunday, Oc- tober 28, he left the stall in the afternoon to attend a football match at

Before cross-examining Ser- geant Fitches, Mr. Macnamara ex- plained that the questions he would put to the witness.contain ed nothing personal at all. He had to ask them because he had been Instructed to do so.

In answer to Mr. Macnamara, Sergeant. Fitches admitted that the accusations brought against him by the accused were made at the Magistracy before the accused had seen any lawyer in the mat- ter and obtained advice.
