Another Witness Evidence was given by Chief En- gine Room Artificer Clarke that he told accused that the machines could not be got ready immediate- ly, and accused replied that the captain had given orders that the work must be done. Accused gave no further orders.

A total fine of $500 or, in de- fault, 6 months' hard labour was imposed by Mr. W. Schofield at Wan S1, Central Magistracy on proprietor of Cheung Tal Co. a painting shop at Staverley Street, who was summoned for (a) using a false trade mark; (b) possession or goods, to wit, tins of paint to which a false trade mark had been applied, with the intention to fraud and deccive; and (e) for applying a false trade mark.
Mr. OEC. Martin, who, pro- secuted said on November 13, the defendant who was painting con- tractor to the Hong Kong and Yaumat! Ferry Ca; was instructed to paint one of the ferries with Hubbuck paint. Defendant brought four tins of paint with him and Mr. Long, an official of the cam- pany noticed that two of them were much lighter than the others although all of them bore the Hubbuck trade mark. Mr. Long be- ceme suspicious and brought the two lighter tins to Messrs. Harry Wicking and Co.. agents Messra. Hubbuck and Sons. The tins were examined and the trade marks on them were found to be false."
Bubsequently, a search was made on defendant's premises by the police and three tins similar to the two were found. The paint was sent to the Government analyst who found it to be different from that manufactured by Messrs. Hub- buck and Sons.
Mr. Märton then produced evi- dence to support his outline after which the defendant went to the witness box and gave evidence. He sald that on November 13, he sent his painters with 4 tins of paint

The tims opened were genuine while the other two tins not were alled up with paint manufactured by Hubbuck and Sans, although they bore that trade mark. Witness told Mr. Long that the two tins in question were brought by mistake and asked to be allowed to take them back to his shop to be changed. Mr. Long, however refused, whereupon he asked his painters to stop work. The reason why, he put different paint, into the tins was that he intended to use it for another job.
