20.--Government's Treatment of Detained Witnesses
· March 18, 1859. We conscientionaly submit to cur readers, that nothing which has yet happened in Hongkong can more succinctly and fully demon- strate the utter inefficency, the disregard to appearances, and the Incapacity for governing, of the present and ministration of the Col- ony. than a review of this Mastiff case, from beginning to end-and this, be it particularly observed, does not apply to one occasion nol to one department, but to a series of improprieties, not accidental but designed, reflecting the utmost discredit upori cach department of government implicated, involving, ultimately the execution of an in- nocent man under circumstances, most dreadful to contemplate.
To begin at the beginning. When six of the crew of the Mastaff were apprehended on a charge of murder, the remainder of the crew, them. or the greater" portion of were detained in jail as witnesses; It is a high handed measure to de- prive a man of his liberty in order to obtain his testimony in a case which does not in the least inter- est him. We freely admit however the necessity of the measure un-
der the circumstances in this Colony. If it were not done, the ends of justice would be continual ly frustrated; but still the liberty of a witness so situated as sacri fced to the good of society, and it surely becomes the bounden duty of the State to alleviate the incon- veniences inseparably connected with a residence in jail as much as possible, as well as to extend full and ample compensation for the time lost, and annoyance caused. These are such reasonable proposi- tions that we feel sure there can- not be two opinions about them. Applying them to the case in point, let us see what was done.) with the crew of the Mastiff who were detained as witnesses. Why, they were placed in close confine- ment, in the debtor's prison, and' put on malefactors fare! The governor of the Jail was exposta- lated, with on the subject. It ap- peared he had already represented the matter to the Colonial Secre-

concluded yesterday when the test on the piled foundations driven by the Hong Kong Engin- eering and Construction Company for the Metropolitan Land Com- pany was completed.
Those who witnessed the test included the Hon. Mr. J. P. Braga (Managing Director), Mr. Horace Kadoorie representing Sir Elly Kadoorie, K.B.E. (Director), the Hon. Mr. A. G. W. Tickle, Director of Public Works, Mr. C. B. Robert- son, Building Authority, Mr. W. A. H Duff (Hong Kong Branch Man- ager, Messrs. Metropolitan Larid Co.). Mr. EH. H. Higham of
Messrs. Davies, Brooke. and Gran (Architects for the Metropolitan Land Co.), Mr. L. W. Amps of Messrs. Logan and Amps (Cr- struction Managers for the new Hong Kong and Shanghai Bank Building), and Mr. H. Braga, En- gineer Hong Kong Engineering and Construction Co, Ltd. Mr. J. Scott Harston, Director, was un- avoidably absent.
