Proprietor Summoned By Residents
́COMPLAINANT'S FOOLISHNESS.
Mr. D. Powell, the proprietor of} the Cathay Dancing Institute, 225, Nathan Road, was summoned be fore Mr. H. R. Butters at the Kow- loon Magistracy yesterday for com- mitting nuisance between sunset. and sunrise on July 8.
The summons was taken out by Mr P. A. Dixon and several Europeans, all residents of Kather- ine Building which is opposite the Dancing Institute.
After hearing part of Mr. Dixon's evidence, his Worship, how ever, abruptly dismissed the sum- mons, saying that as the principal. complainant (Mr. Dixon) was ut present at the time when the alleged incident occurred, he could not tell what had happened...

Mr. Dixon said that on the night in question (July 8.) the or- chestra of the Cathay Dan- eing Institute struck up usual and continued playing till 8.43 when he left his house for the V.R.C night fete. He did not know what happened afterwards.
His Worship: What instruments were they playing?
Mr. Dixon: A piano and several string instruments.
How did it annoy you?-I was not present and I don't know. I am relying on the other witnesses
