Mr. Gavin Simmonds, K.C., for the railway company, said that the application was made to strike out the statement of claim on the ground that it disclosed no reasonable causa of action, that it was frivolous and vexatious, and an abuse of the pro- cess of the court.

The two milway companies were incorporated by special Acts of the Canadian Legislature, and Mr. Boardman was seeking a declara- tion which involved that two Acts of the Canadian Eegislature. to which the Royal Assent was given, were ultra vires, that two Orders in Council made by the Governor- General were witra vizes and illegal, and that two argeements which the Crown, by the Canadian Minister of Rail ways and Finance, was a party; were invalid and of no effect.
Counsel submitted that it was quite impossible for such an action to be maintained, and that the judge had no jurisdiction to say that an Act of the Canadian Parliament was ultra vires. There was, he added, a Canadian action raising exactly those questions, and the writ in that cast was issued, first.
Sir Patrick 'Hastings, K.C., argued for Mr. Boardman that assuming the facta in the statement of claim were capable of proof, there was no question that Mr. Boardman had a substantial cause

At the present time measles and whooping cough have wvertaken the diminishing death rates from the other two dis orders, and it is of great significance that mortality is at its highest in the early years of life. According to Dr. Stocks, the fatality rate in Battersea is 3 per cent, before one year of age, and only 2 per 100 be-- tween 5 and 10 years.
