The case in which Taui Wai Hing was charged with the embezzlemcut of 81,584 from the Sze Yap Steam- ship Company was concluded at the Central Magistracy yesterday when Mr. E. I. Wynne-Jones discharged the defendant.
At the previous hearing, Mr. Prentice, of Messrs. Hastings, Den- nys and Bowley, who appeared for the prosecution, asked leave to withdraw the case, as, he stated. the money had been paid to a sub- Нія ordinate of the defendant. Worship, however, declined to dis- miss the case without further in- vestigation, and remarked that if Mr. Prantice had no further in- structions in the matter he should sand all the documents to his Wors

At the subsequent hearing. Mr. Lea D'Almada e Castro, who up peared for the defendant, argued til his Worship should dismiss the case as the prosecution had with drawn it, and began to outline the history of the case.
Str. D'Almada said that in the civil ense the plaintiff obtained a
judgment and proceeded with a writ of execution by the attachment of the defendant's person and by the detachment of any property
which he might possess. Under that warrant, said Mr. D'Almada, the defendant was apprehended and taken to the debtors' gaol. As was usta!, in all such cases, the debtor, finding himself in gaol, made an application to the Court for his re- lease on the ground that he posse sed no property and swore an ap plication to that effect, and that application was served on the judg- ment creditor.
