Giving evidence, inspector Elston Baid that on the evening of June 1, the complainant in the case made a report to him at the Kowloon City
Police Station of the theft of cer tain articles. At 8 p.m. on the same night, the officer went to.com. piainant's house and made in quiries. He went up to the first floor and entered a cubicle where the second...defendant was staying. In the pocket of a jacket, he found police whistle and a key. The key was later discovered to fit the lock of the cabinet, from which it was alleged that the missing arti cles were stoica. The second de fendant was then taken into Police custody.

Plaintiff was the Hoi Hang Com pany, represented by Li Wai Chap, of 203, Wing Lok Street, the former managing director of the firm, who sued Wong Fung Ng, of 38, Li Tung Street, for $127, in which
