years.

"It appears from the evidence that the parties were married in the city of Manila on January 5, 1920, while the plaintiff was ployed as a clerk in the Govern ment service. After their marri age, they went to live with the wife's parents who were at that time running a boarding house. and, at the end of several months, to wit, in August, 1920, plaintiff claims that his wife left him and went to live with another man. The evidence with respect to his point is rather obscure and indefinite and is supported only by the statement of the plaintiff.

Arrival in Shanghai. ;

"It does appear, however, that in the month of September, 1920, plaintiff resigned his position and left Manila for the purpose of visiting his father and mother, who, at that time, lived in one of the outlying provinges, and, after re- maining with his parents a Tew weeks, his father "sent him to Shanghai, China, to visit an un- ele, and that the plaintiff has lived in Shanghai ever since that time.

"The principal part of the evid- ence adduced at the trial: related to the infidelity of the wife, and it is claimed that four or five years ago the wife had two children. by the man who was supposed to have been the cause of the initial trouble between these parties back in 100. 1t further appears that, in January of this year, plaintiff visited his parents in the Philippine Islands and was in Manila on two occasions at the time of such visit, but that he did not make any effort to acc his wife or to ascertain where she was living or with whom, if anyone.

Finding on Abandonment. "It may be that, the evidence presented at the trial would be suf cient to justify the granting of a divorce to the plaintif en the ground of adultery, but ir asmuch As the complaint does not contain any such charge, and that deser- tion in 1920 is the only ground re- lied upon, I do not feel that it would be proper for the Court to order a decree of divorce upon the ground of adultery when it appears that the defendant has never had any notice, either actual or con- structive, that she was to be charg ed with such an offence.

"I am inclined to think from the

evidence produced that, if these parties had any trouble shortly
