CLAIM.

HOTEL 'BUS AND PUBLIC MOTOR-CAR.

BOTH SIDES HELD TO BE

NEGLIGENT.

Holding that there was negligence on both sides, the Puisne Judge 3. Justice. Wood) dismissed the claim and counter-claim in the Happy Valley motor celliston case, heard recently in the Summary Court.

The plaintiff was Cheung Ho Sang, owner of a public motor car, and the defendants were the Hong Kong and Shanghai Hotela, Ltd.

The claim and counter-claim were based on damage suffered by the two vehicles when they collided nezr the Monument.

In delivering judgment, his Lord ship outlined the facts as found and said he had taken the liberty of obtaining for hiniself expert motorist opinion on the circum- stances disclosed in the evidence. Continuing, he auid-

"I find that the driver of the bus was negligent in proceeding to cross the line of traffic to his Fight, without first informing him- self that the road was clear, and in travelling in the circumstances at the speed substantially higher than five miles per hour.

Before the collision, the car had been travelling fast, but not in my opinion unreasonably fast in the circumstances if the car had been well equipped. It was an Overland Whippet, fitted with four, wheel brakes, and may have been going at 25 miles per hour or a little more. Its driver sighted the lamp ray of the approaching" 'bus before he could see the 'bua itself. The car was then 58 feet from the point of impact.

He at once applied his brakes, but they did not stop, the car in time to avoid the accident. The brakes operated on the right side wheels only.

"I am advised that, had the brakes been properly adjusted, the car, at the speed it was going, would have been brought to rest in less than 38 feet and, also, that the defect in the brakes inust have been known to the driver.

GAMBLING WITH A

FORGED NOTE: STONE-BREAKER SHARPLY

PUNISHED.

A stone-breaker was charged be- fore Mr. T. S. Whyte-Smith with keeping a common gaming house and the possession of a forged Hong Kong and Shanghai 810 bank note. The Magistrate imposed a fine of $10 on the first ebarge, remarking that he regarded the offence as ordinary street gambling, although actually the workmen assembled in A building...

On the mention of the second

charge, however, the. Magistrate changed his order and increased the fine to $25,, the possession of the note making, he said, the offence more serious.

The defendant pleaded that he won the note gambling, but the pro- accuting officer pointed out that he had not said so in making his state- ment.

After the note had been certified ay falsy by the Magistracy shroff, the defendant was discharged on the second count and the note order.

A message was received at the Water Police Station yesterday morning to the effect that a large junk capsized off Stanley and two members of the crew, a man and a girl had been drowned. No details of the mishap were given but it is believed the craft capsized in the rough eens.

In the present case his Lordship held that the driver of the cus was incapacitated by the condition of his brakes (which he had found to "constitute negligence) from prevent ing the injury during the interval of emergency.
