ADVICE FOR INVESTORS.
The parties have had a course of dealing in paraffin wax extending over 30 years. During this period the transactions have been occa- sional only. All eontracts have been "A.M. P." .e. have had no American felting Point in the READERS specification. No similar question has arisen between the parties in respect of any other contract in the series... A recent contrnet (subse quent to that here involved) has been mutually performed, without discussion.
Had this eontract heen, of a date prior to 1922, it could not have been contended that the "American Melting Point mentioned therein was anything else than the result of the American method exactly

of contract. The buyer submits that he is entitled to reject the specification contained in the con- tract. The contract is in writing. It contains the following specificn- tion: "A..P. 125 deg./127-deg." It is agreed that the meaning of this specification is "American Melting Point" between 125 de- grers and 127 degrees Fahrenheit." The melting point" is the tem perature at which solid wax melts, which temperature is the same as that at which the same, wax, when molten, will selidify.

It appears from oral evidence given, and also from scientific text Looks (which are necessible to the Court under Ordinance 2 of 1580, 26. 4), that the American Me thod" of ascertaining the, melting T160 point of paraffin wax is to immerse 7-8th of the Lulb 'of a thermometer in a given quantity of molten wax, and then allowing the wax to cool to note the temperature c which a "spider" extends on the surface of the wax from the edge of the quid to the bulk of the thermome
The American Melting ter. Point is the result ascertained by The English Me this method. thod is different. In this method. the bulb is completely immersed, the wax is allowed to cool, and perindical readings (each period being sixty seconds) are noted. It 34.70 is known that, when the solidify
A:
ing point is reached. the wax gives out heat, which arrests the fall of the thermometer for a time. this stage in the process the read- ings of the thermometer remain constant for a series. The station- ary' figure is accepted as the melt- ing point,
It is obvious that the English method will register a later stage in solidification than the American 'method, that it will record a lower temperature and that it will be less liable to error. The difference between the results of the two me thods is not constant. It averages 2 to 3 degrees.
In recent times dissatisfaction. has arisen in the United States of America with the use of the Ameri can method. There is in Phila delphin a Scoiety named "The American Society, for Testing Ma- terials (incorporated in 1902). This Society adopted in 1922 na ite standard definition of the melting point of paraffin wax the follow ing: The temperature at which melted paraffin wax, when allowed to cool under definite prescribed conditions, first shows a minimum rafe of "temperature change." thug approved for its constituents the English method of test. its official publication, the Society adds the following note to the de- finition: "The so-called Ameri ran Melting Point is an arbitary figure 3 deg F. higher than the A.S.T.M.. Melting Point."
