POINT IN TAXI-CAB LAW.
NOT COMPELLED TO TAKE FIRST ON THE RANK.

A novel point in taxicab law was raised at the Marylebone Police
Court recently. when *C. H.
Werner, a taxi-driver, was sum- moned for refusing to im hired by Mr. Edgar Howard Collins, a Fellow of the Zoological Society and a rating valuer and surveyor, of Lanenster into and Parliament
Street.
Mr. Collins told the magistrate Cr. Hay Halkett) that outside the main entrance to the Zoologien Garding was a rank capable of Adding nearly two hundred cabs which had been in existence nearly forty years. On Sunday evening! Augart 23, he left the gardens with his wife, and, walking down the rank until he came to a clean-look- ing cab, hailed the defendant, who was third, and had about fifty or ixty cabs behind bin. The defen dani imed to the first cab on the rank, indicating that he should fake that, but the witness replied, I want you." The defendant

Mr. A. J. Ray Whiteway, the solicitor defedding at the instance, of the Transport and Generali Workers' Union, urged that under the Parks Regulations Acts plying for hire ned lettering were pro- hibited within the precincts of Begents Park.
The Magistrate asked by whom the rank outside the Zoological Gardens WES authorised. "Ara Whiteway said he believed it was
rank that was not antherised, but was winked at by the authorities.
Mr. Whiteway: My submission 13 that plying for hire within the pre- iefnets of the park is deñnitely for- bidden, and that no summons car lie for the defendant's refusal to emit an offence.
Mr. Hay Halkett: But he ་n་ plying for hire, and when he does he must play the game,
Mr. Whiteway: "He had no right at all in the park as a hackory carriage driver.
Mr. Hay Halkett: He may have n rights, but he has created liabili ties by plying for hire.
The Magistrate found the defen- dant guilty, and fined him 20
