Counsel for plaintiffs submitted that the law applicable to the contract was the law of England. Even if, as was contended, the law of Java applied, the result would be the same as to the custom, the evidence failed to establish it, either as originally, pleaded or as stated in the amendment. It had been shown that the steamer arrived on September 30th, and was rendy to begin loading at 1.30 that after 2000, and could have loaded, the whole of the sugar before midnight, But the sellers did not load, and apparently had not even put the angar into lighters within the re quired time. The inference must be that in fact they had not the sugar ready. Whether the custom existed or not was, therefore, im- material; also, the huyers did not know of the existence of the alleged custom, and were consequently not bound by it, even if it existed.

It was contended that on the evidence there was no breach. It was necessary to corsider the meaning of the word "shipment.". At the port the practice was that for a particular month provided that during that month the goods had been put into lighters. It was not necessary that they should actually be put on board the steamer. The plaintiffs were aware of the practice, and so were all the material parties in the case. The law of Java should be enforced by the English Court in this contract, and by the law of Java the plain tiffs would be bound by any custom which was material, whether they knew of it or not.
