Mr. R. E. Lindzell went to the scene of the collision yesterday afternoon with Mr. Horace Lo and Sub-Insp. Alexander and tests were carried out to see if the car could have straightened out" after a right hand swerve around the lower bend of the Aberdeen road. Sergt. Saunders was at the wheel of a big Buick-similar to the defend ant's car and drove to the instruc- tions of Mr. Lindaell. The road at both ends was closed to traffic and the car approached the bend from Aberdeen at a speed of 18 miles per, hour swerved as instructed- to the right and "straightened out!" so as to be on the left side of the road and negotiate and next right hand corner on the left and cor- rect side, of the road. This test was repeated at a speed of 16 miles per hour, and Mr. Lindsell remarked that he was satisfied that it was possible to swerve as stated by the driver. Returning to the Central Magistracy his Worship said that the result of the test did not warrant defendant's discharge and Mr. La had a case to answer.
The driver, Kwong Fay, then went into the box and said that he approached the bend at under 20 miles per hour. He did not see the lights of the other car until he bad turned the bend. The other 'car was on the wrong side of the read and "a woman was sitting in front and driving. There was also a man beside her.".
