By his reserved judgment, Mr. Justice Evo dismissed the action brought by Miss Gertrude Remira Wenanab Hoskyne Abrahall, of Avenue-road, Torre, Devon, who prefers to be called Miss Hoskyns, against the Paignton Urban Dis teet Council. She claimed the right to enter the vault in the Paignton Cemetery in which her mother is buried for the perform- ance of religious rites which, she said, were observed by the Early Christian Church.

part of the cemetery. All they could sell was the exclusive right of burial therein and the right to dig a grave and construct a vault. With respect to Misa HoskynK'S claim to enter, the vault for the purpose of ventilation and repairy no evidence had been produced that- the vault was ever out of repair, and the council had granted per mission for the construction of ad- ditional ventilators. Misa Hos- kyns, however, would not allow the architect to proceed with the work. As to Miss Hoskyns's claim to perform alleged Christian rites, it appeared that for the first four years after the construction of the vault in 1920 she paid an annual visit to it. In November 1924 the council, decided that no further ad- mission must be permitted without their leave. It was evident from a letter that Miss Hoskyns had left food and drink in the vault."
Cooking In Tomb.
On one occasion she evaded the caretaker, and entered the vault. She lighted a methylated spirit lamp and candles, burned incense, and cooked some meat. Broken bottles and paper were вегед about and for her own safety a police sergeant superintended her removal from the vault.
The proceedings became a matter of public notoriety. The writ in the action was issued after ins Hoskyns had been prevented from entering the vault to deposit flowers, fruit, a cooked bird, wine, coffee, sud milk.
In her statement of claim she said that she and her mother were members of the Orthodox. Greek Church and that the rites were those of that Church, but in the witness-box she admitted that she and her mother belonged to the Established Church.
Mr. Justice Evo said he was unable to accept Miss Hoskyne's view that the rites were of Chris- tian origin or character. They ap- 'peared to be of a distinctly pagan nature and certainly not consonant with burial according to the ritual of the Established Church.
