When the hearing "of the Sunning piracy case was resumed at the Central Magistracy yesterday afternoon, M. Lindsell informed Mr. M. "K. Lo that he had received a certificate from the Medical Officer to the Jail to the effect that the 19th defendant was in hospital. His Worship asked Mr. Lo whether he wished an adjournment, or whether he would agree to the case proceeding in his client's absence.

Mr. Lo raised no objection.

The Crown Solicitor: The only evi- dence against this man is that of Cap- tain Pringle who stated that he saw him on the bridge. It is not supported by

anyone.

His Worship: I have already remand- ed him until January 3rd. If you have nothing further then, I shall have no alternative than to discharge him as I feel that no jury would convict.

Mr. Holmes" said that he could offer no further evidence on January 3rd, but would leave the matter in his Wor- ship's hands.

Mr. Lindsell: The man is in hospital and I will leave the question of his dis charge until next week,

The first witness called yesterday (the 42nd in the case) said that he was No. 1 cabin boy to the Chinese first class cabins on board the a... Sunning. Wit- ness was in the steerage at about 330 p.m., when someone cried out "thieves." He was stopped from going up to the deck. "Some armed men told me not to go any further and that if I did, I would be shot," he said.

Witness remained in the steerage until 3 p.m. While there, he saw an armed pirate ordering all passengers to hand over their valuables. After 5 p.m. wit- ness said that he went on deck to serve food to the Arst class Chinese passen- gers, and there, witness said, he saw several armed men going to and fro Of the men who were there, witness could only identify the No. 1 defendant.

Continuing, witness said that he also saw No. 1 defendant-going into a passen-

Mr. Lo: Do you remember, after leav ing Amcy, going into any second class cabin 1-No.

Mr. Lo: Then you do not know any of the second class passengers-No.

In answer to the Court, witness daid that he was terrified, and that when he was in the steerage, he could not say whether the passengers did hand over to the pirates any articles of value.

Corroborative evidence was given by three Chinese who acted as servants to the officers.

The case was adjourned till Thursday

at 11 am.

A SIKH AND A BANK DRAFT.

Charged with obtaining 8400, by false pretences, a Sikh brought before Mr. R. E... Lindsell at the Central Magistracy. yesterday pleaded not guilty.'

It is alleged by the prosecution that the defendant wrote to Calcutta in the name of the complainant requesting the money to be sent to Hong Kong care of the Hong Kong and Shanghai Banking Corporation, withdrawing same himself upon receipt of the Bank's documents.

Mr. F. H. Loseby, for the complainant, asked for a week's remand.
