PROSECUTION DEMANDED BUT

NOT SUPPORTED.

An extraordinary state of affairs arose in H.M. Supreme Court, Shanghai 'on' December 3rd, in connection with the trial of Jagat Singh on a charge of having murdered a Chinese, Nes Ching Zung. The alleged poisoning of the de- ceased took place in Chiness territory, where the preliminary investigations and the 'arrest of the accused" were carried out by the Chinese authorities, there be- ing no light delay before the accused was handed over to the British Consulate and the Settlement Police were allowed to make inquiries.

In such cases a Chinese official nomince is allowed to attend the Court to watch the proceedings and, if of sufficiently high rank, even sits with the Judge on the Bench Mr. Wu Shou, Kung, secre tary to the Bureau of Foreign Affairs. had been nominated for this purpose, bus though the Judge delayed opening the Court until 20 minutes after the appoint- ed the Court until 20 minutes after the appointed time, Mr. Wa' did not attend and Judge Grain 'therefore went on with the hearing. All the more important wit nesses were Chinese living outside the Settlement and their attendance also,hád been promised, but not one came to the Court. Therefore it was impossible to try the case, although, as a matter of fact, the acting Crown Advocate (Mr. H. Lipson Ward) dropped the prosecution on the ground of insufficient evidence, and the accured was discharged.

Crown Advocate's Explanation.

The Judge:-Mr. Crown Advocatë, I have been looking at the depositions and I want to ask "if you have any more evidence.v

The Crown Advocate:-No, my Lord. The Judge:-It apears to me that there is very little evidence to go before the Court.

:. The Crown Advocate agreed and said:

In the ordinary way I should have entered a nolle prosequí, but having regard to the fact that the crime took place in Chinese territory, that the de- ceased was a Chinese subject and that the prosecution was commenced by the authorities at the express wish of the Chinese authorities, I thought it better that the matter should be brought before you in open Court After what your Lordship has said, and having regard to my own views, I cannot öffer "any evidence on behalf of the prosecution.

Chinese Default.

There is one other matter I should like ta-mention. I understand that, as for as the witnesses who reside outside Settle- ment limita are concerned, the Chinese authorities have been requested to take steps to ensure their attendance this morning and I understand that none of them are present now, so even if we wore satisfied that there was a case to go before the jury, we could not proceed with it. Therefore, I offer no evidence on behalf of the Crown.

His Lordship reviewed the evidence and the jury returned a verdict of "not guilty." The accused was at once dis charged, the fudge stating that he left

FORCED CONVERSION

SCHEME.

One of the biggest financial operations evar attempted in any country, accord- Ing to Count Volpi, the Finance Minis- ter's own definition, has been applied in, Italy with the consolidation of more than twenty and a half billion lire (about £183,000,000) of fluctuating debt. The -King has signed a decree authorising the Treasury to issue a new loan bearing.6 per cent. interest, which will be given in éxchange to bearers of Treasury Bonda. The new loan will also be offered to the public at 873 for each nominal 100 lire

A syndicate has been formed composed of the Bank of Italy and all the savings', banks and insurance companies to pro vide a market for the loan, these institu- tions being obliged, between November Ifth, the date of the flotation, and December 31st, 1927, to invest in it at least half, the auma at their disposal. The money thus raised will be employed in credit operations on the security of the new loan or in redeeming short term Government debts
