FALSE STATEMENTS ALLEGED.- The case in which the managing part- ner of a local Chinese firm is alleged to have made false statements to the Official Receiver, in relation to a petition in bankruptcy fled against his arm in February, was concluded at the Central Magistracy yesterday afternoon, when Mr. R. E. Lindsell committed the de- fendant for trial on four charges,

There were originally five charges pro-
·ferred against him (1) that he made false statements to the Oficial Receiver; (2) that he sold the business without the consent or knowledge of his two partners in Cauten: (3) that four important books. relating to the financial transactions of the firm had been destroyed, multilated, or had disappeared; (4) that, the bank- ruptcy proceedings were entirely collu aive between the petitioning creditor and the defendant; and (3) that petitioner's debt and other debts shown in the books of the firm were fictitious.
LEGAL POINTS.
At the previous hearing of the case Mr. Watson, who then appeared for the defence submitted various questions for His Worship's consideration.
Among other things, he contended that there was no evidence to support the perjury charge.

- ANNUAL REPORT,
The annual report of the Hougkeng & Territorial Estates, Ltd., for presentation to the shareholders at the second ordinary annual meeting to be held at the office of the Company on Thursday, May 20th, at 11 am, is as follows:
The balance at debit of Profit and Loss Account for 1923 is $109,5206.18 composed principally of interest on mortgages and loans, all of which has beer, charged as in our last year's accounts to Proft and Loss Account.
With regard to the contention by the defence that there was no evidence to show that defendant intended to defraud, His Worship held that it was for the defendant to satisfy a jury on the point,
M. L. R. Andrewes, who appeared for the defence, agreed that the onus was en the defendant to do this.
His Worship further held that charges four and five should be dismissed.
Mr. Brooks then applied to put in an- other charge under the Bankruptcy Ordinance, relating to the making of false entries in the firm's books after presentation in bankruptcy.
His Worship decided that there was a prima facie case to answer on the two original charges (one and three). He in- cinded the two additional charges made by Mr. Brooks and then committed de- fendant for trial at the Criminal Ses- sions.
