A CHINESE PARTNERSHIP
DISSOLVED.
Before the Chief Justice (Sir Henry Gollan), in the Supreme Court yester day, Mr. Eldon Potter, K.C., applied on behalf of Tong Bhi Wan, and a miner named Cheung Shiu Chung, of 180, Queen's Road, for the dissolution of the partnership of the Chau Tong Tung Kea medicine shop, and thereby create an order whereby Liu Chin Wah the managing partner, would no longer be partner of the firm.
Tong Shek Wan said in evidence that Le was the sole survivor of the original partaars of the firm, which was formed. in 1904, with a capital of $10,000.
At this stage His Lordship asked if defendant was present. Mr. Potter re- plied that he was, although he was not legally represented. He had, however, consulted four solicitors and two counsel on the matter.
His Lordship: A multitude of counsel has been his confusion.
Continuing, plaintif said defendant's father was a partner in the firm, and on his death, defendant was admitted into the firm, and given the post of managing partner. Plaintiff had become dissatisfied with defendant's work, be cause since 1920, he had never rendered any accounts, nor had he paid dividends. Prior to 1920, this had always been done. Plaintiff bad through his solicitors, Messra Wilkinson and Grist, offered to purchase defendant's share in the busi- neas, but he had refused to sell.

Why did you not say this before? You now wish to raise such a point as that, without having given any warning to the plaintif-I only found out the truth during the last few days.
Defendant alleged that plaintiff had no right to use the name he used. It wa his father's name.
Mr. Potter maid that plaintiff's father died in 1905, ten years before the part-1 nership was formed.
Replying to His Lordship, the defend- ant said that was the only point he wished to raise, and alleged that when plaintiff's father died, he left the shares to a person to look after. This person was not plaintiff.
His Lordship said that he would not allow the defendant to take part in the proceedings, because he had had plenty of time to have raised that point and bad not done so until the last moment. He could therefore pay no attention to him...

MARINE COURT CASES. FIREMAN SENT TO PRISON. DISOBEYED 2ND ENGINEER'S ORDERS.
At the Marine Court yesterday, be fore Lieut.-Commander G. F. Hole, R.N., a Chinese fireman of the s Benarty was charged with "unlawfully and wilfully disobeying the lawful com mand of the, 2nd engineer while the Benarty was at sea on March 20th.
The Master of the Benarty gave evidence to the effect that the defendant was signed on the articles of the Benarty as a fireman.
Mr. Frederick Gray, 2nd engineer of the Benarty, Buid that on March 20th about 7.30 am. he went to the stake-hold, where defendant was on duty. He order- ed defendant to shut the check valves in the boiler fires, but he did not comply with the order and witness had to do it himself. Witness told defendant to have the them shut while he returned to
When witness returned to engine room the stoke-hald he found the valves open again, and he again ordered défendant to shut them. He made no attempt to do so and witness again had to do the job himself. Witness went back to the engine room, shortly afterwards return- ing to the stokehold, when he found the valves were again open. He again order. ed defendant to close them, but he did not do so, witness having to do it for the third time himself.
Defendant said he was told to shut the valves for closing the forced draft and did so, but the steam went back so much that he opened them again. The second engineer came back and found the valves open and told defendant he The second had disobeyed his order. engineer told defendant to shut them again, and he half shut them. The engineer then closed them completely and remained in the stoke hold until defendant finish his duty at 8 a.m.
His Worship sentenced defendant to two weeks' imprisonment with...hard labour and also fined him two days' pay, ordering that his maintenance while, un- dergoing sentence should be defrayed from his wages, and that defendant be paid off before the Deputy-Bhipping Master after leaving prison.
OTHER CASES.
A junk-master was fined 815, with the alternative of two weeks hard labour, for failing to exhibit regulation, lights on his junk while under way.
