The litigation of which the petition for a certioriri'is a consequence, started on April 3rd, 1923, when Mrs. Padovani commenced suit against Carpi before Judge Simplicio del Rosario asking for the appointment of a receiver to take charge of the funds of the Italian Opera Company which she said she owned and for which Corpi she alleged was employ- das manager. Mrs. Padovani brought a petition afterwards before the Supreme Court asking that the decision of the lower coure be reviewed, but the petition was denied by the high tribunal. The case was later transferred from Del Rosario's to Judge Harvey's court;

The latest phase-of-the-litigation as pending in Judge Earvey's court was for the appointment of Carpi as receiver of the present Opera Company! The amount of the bond called for in the receivership tras P.20,000.
