The following letter which was address ed by Karakhan," the Soviet Envoy. to the Chinese Minister of Foreign Affairs has bevn' published by the Bolshe vist News Agency at Peking:-

Plaintiff is his capacity as offerr, should have known the condition of the ship and should have been careful at all times as to whether the ladder was safe or unsafe in going up or down. It was partly through his own care- siness that he had fallen down and as a result sustained injuries which in no way could attach blame to the China Merchants' S.N. Co.

The Court, however, took into conside- ration the gravity of plaintiff's injuries sustained as a result of a fall in the course of his public duties and also of the fruit that it would be impossible for his bulth to return to a normal state.

The China Merchants H.X. Co. would therefore, be ordered to pay to plaintiff compensation in the sum of Mex. $10,000, including in this amount salary and Eurther medical expenses of plaintif

The Court considered it necessary to state that the case could in no way bars considered as a precedent. The judg ment, was final and the Court was not prepared to hear any application, for a rehearing.
