The action of the American millionaire, Mr. Frank Jay Gould, to prevent his former wife, the dancer Edith Kelly, from using his name on music-hall bills cams before the First Chamber of the Civil Tribunal on December 13th, and the bear- ing revealed some "piquant details. Mr. Could had divorced his wife, who had sought another partner. and for this. reason no alimony was claimed. He mar ried again, his second wife befng & French lady. Living in France, he did not like to see his name an the walls of Paris with those of other music-hall artists whom his counsel dubbed, some- what skittish. He therefore asked the.. Court to prevent his former wife from using his name on pain of paying 100f. for each infraction anil to impose 10,000f. damages on the Paris music-hall for each Miss publication of a bill bearing it. Edith Kelly, as she must be called until the Court decides whether or not she has a right to the name Gould, argued that she was compelled to earn her livelihood as a dancer is her husband had left.her without resources, though when she part- ed from him she had $100,000 and jewels said to be worth 3,000,000. given some interesting details of the annual budget of a dancer: 324,000€. for clothes and linen, 0,0002, for food- an item which drew the remark from counsel that if she ate at this rate sho would certainly lose her figure; dentistry. 118,000. The famous advocate Maitre Heuri Robert, who championed Miss Eith Kelly, described" the action as that of a wicked American" ngainst a poor little EnglishwomaRI, and argued that Mr. Gould had. by instituting the proceed ings, provoked the situation of which de complained. for when it became known. that he was seeking to prevent his ex wife froth using his name, crowds flocked to the muse ball to see her. Why bad ha let his wife appear on the music-halls under bis fame for three years? Besides Gould was conna nate in the United States, as common as Durand in Fracer. In point of fact, there was a Jay Gould playing in a circus in New York at the present time. Why did not Mr. F. J. Gould protest! Not only Maitre Henri Robert, but Maitre Bousset. who appeared for the music-hall in ques tion, objected to the claim for damages, insisting that the managenent had acted in good faith. Judgment was deferred.
