THE ARMSTRONG TRIAL: JUDGE ON CIRCUMSTANTLAY.
EVIDENCE.

After a trial occupying ten days, at Ifereford, Major Herbert Rowse Armstrong, the Hay solicitor and justices' clerk, was found gulity on April 13th of the murder of his wife by poison, and was sentenced to death by Mr. Justice Darling. The case evoked extraordinary interest, and the ecurt was besieged each day by persons wishing to listen to the proceedings.
Armstrong's only word after the verdict a. "Nothing," in reply to the question" why sentence should not be passed upon. him. He received his doom more impas sively than the Judge, who pronounced it. A visible pallor spread over Mr. Justice Darling's features as he spoke of the awful crime" and of his entire on- currence in the finding of the jury, and nttered the words of the penalty. The prisoner at the Bar stood erect, un- mored: the higher colour that has marked his features throughou; the triablid not leave his cheeks, and he seemed to grow taller stillons he moved mynd to descend below.
It is now suggested (writes The Times. representative) that the prisoner will appen?" against the, verdier, presumably on the ground on which appeil seemed on the very Arst day of the trial to be invited by Mr. Justice Darling when he ruled the evilence in the attempted murder charge--the case of Mr. Martins admissible in suport of the charge of murder. Objection to this! course had been taken by Sir Henry Curtis Benuett, and Mr. Justice Darling, in then giving his decision, id that if he was wrong a contrary decision by the Court of Criminal Appeal would entirely upset the proceed- ings. He repeated this in bis summing-up, The Attorney-General, after the prisoner had left the Court, obtained leave to treat the charge of attempted murder as a remanet for die Herefordshire Summer Assizes. The likelihood of an appeal suggests that a murder case which has ocen pied public attention for more than three monthis may still provide surprises.
THE PACKET OF ARSENIC.
The 10 days trial had its unquestionably dramatic moments, but nothing surpassing in anexpectedness Sir Henry Curtis Ben nett's production just a week ago of packet of 2oz. of white" arsenic (that is, neoloured with charcoal) which was found by Armstrong's solicitor welged at the back of the drawer in the bureau in the prisoner's study, six weeks after both the Scotland Yard officers and the local police had failed to End anything in that very drawer. This packet of arsenic become one of the cutstanding features of the trial. Introduced as an important part of the caso for the defence, it came to play as important a part in the case for the proseenthis. Arinstrong's own story concerning this pucket of poison, and the little pucket found in his coat pocket on his arrest, was analysed with relentless-logie-by the Judge in his summing-up.
Mr. Justice Darling's method in summing! up the case to the jury was try strip it of all_prejudicial and suggestive accessories, and to proceed by the exhaustion of one possibility after another to the conclusion that one hand alone could have administered to Mrs, Armstrong the arsenie from which she admittedly died. He said nothing about motives: he spoke only of "the criminal mind." He senssed neither the two wills of Mrs. Arinstrong nor the widower's marriage proposal less than three months after his wife's death. The prosecution theinselves bad abandoned in the Assize Court, as unfairly prejudicial to the prisoner, several allegations made in support of their case before the ma gistrates. Still tnore noticeable were the transient allusions of the Juge to the conflict of expert opinion: it was as though The ready testimony of Dr. Toogood and the two local doctors called by the defence to the eminence of Dr. Spilabary and Str William Willoor in the field of medical jurisprudence and the special department of toxicology swept all challenge of their
vens out of Court.
SUICIDE THEQET 'AHSUND.' The Judge dealt at considerable length with the suggestion of the defence that Mrs. Armstrong committed suicide, quoting free- 1 from the evidence of the nurses and Dr. Hincks, and laying emphasis on Nurse Allen's statement that six hours before" she died Mrs. Armstrong uttered as her last words. MT. Justice Darling's assertion of the superior validity of circumstantial to direct evidence will also be noted as an outstand. ing feature of a memorable case, and so will his virtual justification of the wide, spread publicity which has been given to it, when he said that the case, was not only an important but a "deeply interest ing conada case of very great, im- portance to the public,"
