prosecution was begun, before Mr. AE. Lindsell, at the Magistracy, yester Hay afternoon, which aimed at fixing the responsibility for what Mr. Tinson, who prosecuted, described us a clever fraud. One man was charged with obtaining 1 bags of dried mussels, worth $800, by fileo pretecoes, and another was charged with receiving." At the commence ment of the proceedings, however, the charges were amended so that both were charged with obtaining and both, alter- untively, with receiving,

Mr. G. G. N. Tinson (of Messrs. Johnson, Stokes and Master) prosecuted, and Mr. F. X. d'Almada defended one of the defendants

Mr. Tinson explained that the first defendant was a former employé of the complainants bus was discharged after China New Year because business way dull. He had worked, since then, with afrm on another floor in the same build ing and still took his meals with the complainants fokis. On the morning of Beptember 15th, the first lefendant visit ed the complainant's godown and three minutes later, an unknown individual arrived with an apparently genuine order from the office that 14, bags of mussels were to be delivered to the address of the reput defendant. Then they were Pepacked into smaller bags and soa were despatched, forthwith to a third. party with whom arrangements had been made, beforehand, to sell mussels on coin

address.

The Magistrate remarked that the egi. dence against the first defendant did ant

Mr. Tinson said that evidence would be called whien would connect him with the fecand defendant.

Evidence was given by a clerk that it would be possible to abstract order forms from the place where they were kept.

An indication of complications" in the case was given by the coolies who made the transfer of the goods from the godown; they said that neither of the defendants was the person who employ ed thear..

The hearing was adjourned.

In support of the claim Mr. F., X. d'Almada called evidence to show that the plaintiff pawned a diamond ring and some jewellery to raise $500 as expital. The arrangement was to be a "Sifty- fifty one, and both women went to Singapore with a stock of jewellery, soap, toothbrushes and other miscellanea After peddling their wares around Singapore, Ipoh, and Taiping they found, on returning to Hongkong, that their expenses had exceeded their receipts by $620,

For the defendant, Mr. G. R. Haywood contended that the trip to Singapore, was single venture on the part of plaintiff, Mr. Haywood said the issue was whether or not it was a partnership venture and his case was that there was no agres ment.

Evidence was called by buth sides and documents relating to the venture were put in.

in giving judgment, bis Honour said the evidence given was unsatisfactory and none of the witnesses strack him as being entirely frank. The fact that defendant accepted certain papers as being an account of the venture showed that it was a partnership. He found, as a fact, that these papers were presented by de fendant to plaintiff in July last and at the same time defendant returned a quantity of jewellery and accounts generally under- the partnership He would give judg ment for plaintiff, with costs.
