ARRESTING A GOVERNOR. HIGH COMEDY IN ILLINOIS:
NEW YORK, July 27th.
As reported here to-day, there is an element of high comedy, worthy of a Gilbert and Sullivan opera, throughout the proceedings involving the liability to arrest, of Governor Small, of Illicois. It is charged that his Excellency, while Treasurer of the State of Illinois, did unlawfully apply to his own use some thing over £100,000 of public money, and is therefore subject to arrest. Governor Small advanced the medieval theory that "the king can do no wrong," and inas much as he had been duly elected Gover nor of the great. State, he was de facto king, and entitled to immunity. Small threatened to call out the State militia to defend his prerogatives if the sheriffs went so far as to send builiffs to seize his body.
Judge Smith, sitting at Springfield, assisted by many lawyers, solemnly and carefully examined his Excellency's plea and determined that the theory that the king can do no wrong. is medieval, monarchical stuff" which does not run in these United States, and has never. been applied to duly elected American officials. Our Governors," said Judge Smith, are not born kings. They have no haloes around them and do not rule by divine right. The judge denounced Small's attitude as that of a king above his subjects, and said that the argument that his Excellency could call out the militia to prevent the service of writs upon him left the Court cold, because the officer in command of the State militia would disobey such order as unlawful
Mr. Alfred Filer, himself a former State Governor, dwelt upon the terrible results which might ensue if Small were arrested and thrown into gaol, because while there he would still be Governor, and could pardon everybody, including himself. Judge Smith's written decision declaring that the Governor is liable to due process of the law is a long and interesting but wordy document proving that ancient methods differ from modern.
