One of the ing evidence was given, he submitted, to defendant's friends came out of one of justify a conviction and (3) that material the houses and helped him. witnesses were not called. Therefore, on the evidence as a whole, the conviction was bad. Mr. D'Almada summarised the evidence as follows:-

(3) The No. 1 coolie said each man

accused the other.

(4)-A coolie saw the defendant, at Wuchow, place two packages under the firewood.

Mr. D'Almada remarked that there had been prosecutions" of steamship com- panies and it was got unlikely thas come panies would like to absolve themselves from blaine by trying to bring the guilt home to coolies.

Mr. F. E. Nash, who prosecuted at the hearing, said the quantity of opium found was less than that for which the owners of the ship would be held liable under the Ordinance.

(

The Magistrate said he would have certain qualms in taking the evidence of the man who said he saw the packages bidden at Wuchow, unless it was eorro hornted. The second defendant's evidence. he would not take alone, either, but when two apparently quite independent parties gave evidence which agreed, he felt that It could be accepted. He could not help identifying the packages hidden with the packages found.

Mr. Orme was referring to the inquiry instituted by the shipping company when Mr. D'Almada ubjected that such in quiries were got evidence.

The Magistrate rejoined that it was really a very satisfactory way of inquir- ing into such a mutter, in the case of a purely Chinese company; no obstacle should be placed in the way of such inquiry. In re-opening a case of this kind, in which there, were cross-purposes, the danger was that instead of getting nearer to the truth one got further from it. "I do not think" concluded Afr. Orme, that there is any real ground for re-opening the case, or any reason for suspecting the bond hues of the witnesses who gave evidence; I am sure they gave it reluctantly, I do not feel, that the ends of justice will be advanced by a re-hearing."

Defendant said he engaged she chair opposite the Central Marked for his wife. He engaged one for himself little higher up the hill. They stopped only for a few seconds at a shop, and then proceeded home. The journey did not take more than a quarter of an hour. The legal fare was 50 cents but he gave the complainant 3 cents because he had. to carry the witness's wife up the steps to Belilios Terrace. The complainant used insulting language toward his wife, and witness struck him. In the scuffle he accidentally fell backwards on the chair and damaged it.
