In the House of Lords, on, April 12th, Viscount Burnham (Daily Telegraph) moved the omission of the following subsection from the Matrimonial Causes Bill:

It shall not be lawful to publik any report of any proceedings under this Act until the conclusion of such pro ceedings, or to publish any pictorial representation of such proceedings, and any person acting in contravention of the provisions of this subsection shall be guilty of contempt of court "and punished accordingly,

He was hardly to blame, he said, if he repeated the arguments against the con- stadi attempts that were being made to interlere, by arbitrary and partial enact ments, with the common right to publish and report proceedings in matrimonial chuses. It was a curious thing that there was not one of these sexual questions, in which the House now spent so large a part of its time, in which there was not an attempt to curtail and abridge the liberty of the Press. On the other hand, it was only in the consideration of the Criminal Law Amendment Bill that | the Lord Chancellor obtained, by an amendment outside the scope of the bill, the abolition of the stautory veto put on the reporting of proceedings in cases of incest, and he had the support of the Bishop of London. Last year, when Lord Buckmaster's bill was under considera- tion, it was proposed to give the judge the right to decide whether the proceed- ings in such cases were to be reported For not, "and that clause, by the unani. mous vote of the House, was struck out of the bill. Of course, there was a great deal to be said for the rule of secrecy, but he ventured to think that proposals such da were now before the House struck at the very base of British justice. as it had been established and fortified for a very long time. In the old days secrecy in judicial proceedings was "a maxim of State. He could not see why it should only be applied to moral cases It seemed to him that the judges who wished the Cato-street conspirators to be tried in comeru were logical, and he did | not see that there was any argument which applied to moral cases which did not also apply to criminal prosecutions. There were always weakminded people who would be influenced by example. If it was good to prohibit the reporting of proceedings in these cases, why was it not equally good in the large number of criminal prosecutions which came before, the courts in the ordinary way."

This clause did not provide against re- porting the proceedings in matrimonial causes as a whole. It said that no re- port, was to be published until the decree; had been pronounced and until the con- clusion of the proceedings. He was the last person to contend that there were not a large number of papers and publi- estions which might, and did, dram profit from the reporting of what took place in these cases, and that there was not a considerable public which, by u perverted taste, seemed particularly to enjoy them. But that sort of argument would lead to conclusions which would be very damaging to the public weal. Tha particular provisions that Lord Gorell had introduced into this bill seemed to verge on absurdity, if he might say so without offense. The noble lord said that no proceedings were to be reported until the case had ended and, the decree bad been pronounced. In the, ordinary way, if the cause fere perhaps not of great importance, but of considerable interest, that would mean that these proceedings would be specially reported by what was known as the Sunday Press the weekly Press published towards the end of the week, either on Friday or on Saturday He ventured to think that in all prob ability these provisions would actually in crease the amount of publication, and publication of the worst kind. Lord :Farmoor said he would like to support the amendment to exclude the

He did not wish to press unduly on their lordships a sub-section which was charac terised by the noble Viscount ne absurd. In inserting it he acted solely on the commendation of a member of the Royal Commission, who was in authoritative and experienced journalist, Mr. JA Spender. He did not know what view would be taken of this amendment by the noble Lord, who, he understood, was to assume charge of the bill, but he hoped their lordships would not accept it.
