G. DA ROCHA.

IS THE AUCTIONEER

It was because Mr. Tatino Morita, formerly s professor in the Imperial Uni versity of Tokyo, wrote an articla "which might lead his readers to suspect the in- violability of the Constitution and to doubt the foundations of the right of private property," that he was sentenced to two months imprisonment by the Tokyo AUCTIONEER, Chibo Saibansho.

The court has issued a lengthy state- ment, giving the reasons for its judgment The Morito case grow out of an article written by Mr. Marito on the doctrines of Prince Kropatkin, in university quarterly review. The court's statement is interesting as showing how the courts interpret the Press Law in regard to the publication of ideas connected with the newer forms of social theory.

*** In his preface to the article on Kropatin, anys the statement, Mr. Merito declared that the ultimate end of life is the ass freedom in social life attainment of free personality. is political and economic freedom. CEGED ANARCHY AND COMMUNISM. The abolition of nationalism means the abolition of political authority and the destruction of capitalism includes that of the system of private property. The former will lead to the realization of an anarchical society, and the latter to the establishment of communistic society. Anarchism leads to communism and com manism to anarchism: the two systems are inseparably intertwined. Despotic government subsiste on an agricultural slavery system, and parliamentary goren- ment on a wage alavery system. Com

STATE AND WAR ARE SYNONYMS.

"Under the present circumstances State is synonymous with War. One State wants to occupy and ruin another State by foreing upon the latter its own law, politics and commercial trenties. wants, in short, to prosper at the comp others. The State that ought to be, the protector of the majority-the-werker classes is in reality turned into a weapon by the wealthy against the poor, by the propertied against the unpropertied. This fact is as true in a strict sense of modern constitutional countries as of any others. The right of voting, the freedom of speech and publication, the liberty of security one party organization, the of private communication-all these are the capitalista wesperis against the aristocrats, but the labourers are not allowed to employ them against the capi talists. These rights can be made the labourers' own not by nominal legislation but only when the people grow in power to such an extent as their will and wishes are held in due respect. With the modern State, law is anything and everything: what is the law in itself! It is Bothing but notame of taccial custom essential for the preservation of the human tribe, and also the custom establish ed for the assertion of the power of the strong by, utilizing the superstitious ideas of the weak In short so long as society admits of the law of retaliation, and re barracks, and

MOET TURN TO ANARCHIT, "If you want to enjoy the perfect, in dividual liberty and in consequence to claim full respect of individual lives, you ought to take an exception against the control of man by man and perhaps to admit the fundamental theory of anarch ism which you have so long disparaged. Anarchist-communism is not a Utopia, bat founded on reason. It is indeed an ideal based on historical actualities. Kropatkin's doctrine is social idea. For its realization, however, all the radical measures advocated by Kropatkin should be discarded. The social ideal should be attained, through the peaceful, incessant organic development of society. This social ideal will be the permanent and perpetual inspiration to the masses. of people and is destined to win an niti male victory." A

The statement then proceeds to explain in what light the above statement of Mr. Morito should be held in the eyes of those who interpret the nation's laws
