It appears that, acting on information rocaived, Sergeants Cockle and MeFill, of No. 2, Police Station and some Chinese detectives visited an opium divan, sit ed on the ground floor of No 17h Prays East, to execute a search warrant. When they entered the premises, they found a number of men sitting on a bed. As soon as the men saw the Police officers, two of them pulled out revolvere. The sergeants closed upon the man and grappled with them for the possession of the weapons. The man whom Sergt. Cockle tackled attempted to fire his revolver, but the Sergeant held it, and, as he did so, two cartridges fell to the ground. He wrested the pistol from the man's hand. Sergt. MeFall, also succeeded in overpowering his man and took a pistol away from bima.

The men were yesterday brought before Mr. J. R. Wood, at the Magistracy, and were charged with the unlawful posse sion of revolvers and ammunition, and with attempting to shoot the Police officers. It was stated in evidence that both the revolvers were fully loaded, and on Sergt. Cockle's man 29 rounds of am manition were found, tied to his waist band.

Mr. Potter thereupon submitted that they were entitled to see this opinion be cause any privilege that had been plain- ed for it had been waived, as it was subse- quently relied on in the affidavit to satisfy his Lordship that the mah was acting: bona fide,

His Lordship remarked that if counsel's opinion were disclosed it would disclose qded for hearing everything, to which Mr. Potter replied that he could not help that. They could not have it both ways. If that was the position they would have the extraordin- ary result that they could never check a man's statement.

The Chief Justice said that Mr. Alabaster was in Court and he would not

let the witness say be advised him if he did not.

Mr. Potter agreed, adding that he only wished to test the statement. There was a suggestion that counsel gave an opinion which might cover the whole case. Ha did not want to take any advantage: of the other side, and suggested that his | Lordship should look at the opinion. They felt that the defences which had been raised had never been put to counsel and he had never advised on them. The defences of recession of the agreement and misrepresentation were never raised until the case came into court.
