SHAMEEN NOTES,

(FROM OUR OWN CORRESPONDENT]

SHAMPEN, Naу 25th.

EMPIRE DAY, Empire Day was observed at Shamen on more patriotic lines than in former yours. The Bunks were closed and must of the officer closed for the day at the tiflio recess. Almost all the business houses, flow the Union Jack, and

many Residences were decorated with this emblera of liberty and freedom. At tho British Consulate the new silk flag prosented by the ladina of Shameen

waved in the breeze.

In the afternoon at 4 n'clock there was a parade of the Shameen Defence Corps, Advantage was taken of the opportunity to hold a drill competition for a Cup presoated by Capt. Hector, Commandant "of the Corps. All the four sections com- peted, and No. 2. Section (Portuguese) secured lite verdiet by the unanimous decision of the three judges, namely, Consul-General Jamieson, Capt. Hector and Lieut. Kitching. No. 1 Section,

splendidly, was placed a good second, having lost premier honours by a very narrow margin.

THE TONG SHUN CASE.

APPEAL TO BE MADE TO PRIVY COUNCILS

At the Full Court yesterday Mr GC Alabaster made application for leave to appeal to Privy Council against the judgment of the Court of Appeal in the Tong Shan case. The Court of Appeal upheld the decision of the Chief Justice setting aside a mortgage from Tong Shan to the appellants.

Mr. Alabaster said that the only ques tion which their lordships had to decide in considering the application was the question of stay of judgment pending the appeal to Frivy Council;

ne. The stay, he

contended, should be granted, as the plaintiff was a resident of California and might leave the Colony at any moment. As a result of the judgment of the Court of Appeal appellant had been paid the costs of the Court below, and had also been allowed to collect the rents of the property concerned in the mortgage. If the appeal to Privy Council was success ful they would have small chance of re covering the rents collected, and he sug- gested that the indemnity hitherto given

citors for the defendants in the original astion, that they should hold the-money so collected, should continue.
