Mr, Alabaster (instructed by Mr. F. B L Bowley) opposed the motion on behalf of the Official Resciver, and put in several preliminary objections to Mr. Potter's motion. In the first place, he conten led that Mr. Potter had no locus stands Inr making the application, and, secondly, that the application was out of time an·l date. Mr. Potter could not be heard on the motion at all because he alleged thai he was not a partner in the bankrupt firm. If that were so, why should he apply for the bankruptcy proceedings to be set aside ? A stranger could not come inth Court and ask for a petition to Lé set aside against a firm.
