It was 2 peculiar position. At the request of the defence a written judgment was nude, and at their further request on the 18th October, when they went up to the Magistracy-unfortunately the Crown were not there--the Magistrate addett to that at their request, and now the defence came along and sought to vary or affect the judgment still further by an affidavit as to what had been said by the Magis trate and Mr. Potter at the Magistracy.

The Chief Justice-Had the Magistrate been in the Colony I should certainly have asked him to confer with us, but he is not in the Colony. His lordship added that he had taken the view. throughout that there was no ambiguity in the judgment. Mr. Potter had said that the Magistrate amplified his judgment in the terms be sked him to do. He (the Chief Justice) had always been opposeil to that sort of thing going on at all.

Mr. Justice Gompertz. said he had never felt that the judgment was in any way ambiguouĄ, He also followed the Chief Justice in his view on the other? point.
