WHAT THE JUDGMENT BEANS.

Tho effect of the judgment, explained Mr. John Mitchell, Chairman of the Penang Chamber of Commerce, to a Pisang Gazette representative, was that people would not comply with the require mests of the shipping companies for these extraordinary charges. According to the judgment, merchants can obtain their goods when they require them, without having to pay any general average deposit, nor are they responsible for the charges of unshipping and reloading. The judg, ment will certainly have the effect of preventing people from signing away their righte. It is these demands which have been responsible for so little cargo having yet been delivered."

GENERAL AVERAGE." Average, it is interesting to point out, is the term used in maritime commerce to signify damages or exponses resulting from the accidents of navigation. General average arises when sacrifices have been wide, or expenditure incurred, for the pr ervation of the ship, cargo and freight from some peril of the sea or from its effects. Orders have been issued by the Com- ander-in-Chief India regarding the war training of Territorial Infantry in India, which say that battalions of Territorial infantry newly arrived in the country would undergo a course of ruining which had for its object then preparation for active servico in the field in the shortest possible time. The Kitchenor test of 1004 had been considered by the TFor Commander-in-Chief the best all-round standard for the purpose and was accord- ingly republished with cortain modifica thons which were found necessary in order to bring it up-to-date, and to adapt it to the requirements of the present situation. The marks allotted to the different sub heads were increly an indication of the relative, importance attached to the several points included under each main heading, and were intended both as a guide to officers commanding battalions in preparing their command and to inspecting officers in Rasossing the efficiency of units tested by them. This has resulted largely no doubt from the activity of the British Government in maintaining the right of search of vessels on the high seas for contraband of war as well as the scrutiny into the circumstances of the transfer of vessels of belligerente as to whether the sale of vessels to Americans is a bona-fide transaction.

This is, of course, a serious interference with commerce, but a belligerent nation has a right, according to the terms of the Declaration of London, to satisfy itself use whether the sale of an enemy s vessel was made in order to evade the conse quences of capture and confiscation to. which it would be subject under the flag of a belligerent country
