There were many cases
in which the Magistrate had not final jurisdiction, and that case was one of them..
Mr. Slade interrupted here with the remark that Mr. Potter was not keeping to the points which he had to answer. He was beginning to reply on the whole question of res judicata, whereas be, Mr. Slade, wanted 1. reply to the points he had raised.
M. Potter said he only intended to speak of the new point which had been raised; as to how many points on which a Magistrate could give, or not give, a final decision. The word "final" had not been used in a correct sense by. Mr. Slade. Did he mean that the decision of a Magistrate in investigating an indictable offence was final in the sensé that it could never be revised? The mere fnet that the judgment could not be revised did not necessarily mean that that was final at all, for there was appeal. Mr. Slade That is not my argument -at all. My friend bas set up an argument himself which he assumed is mine. It is not mine, it is nothing like mine.
His Lordship remarked that he assumed Mr. Slade's argument was that the Magistrate trail a final decision in some enses, but this was not possessed by a Magistrate in ajiother case.
Mr. Stade added that Mr. Potter had used a certain. remark of his-which could not be revised in a higher Court"- hub he was treating it in an entirely different sense.
Mr. Potter.said that his submission was that where a Magistrate investigated an -indictable-offence it was but a prelimin
ary inquiry. Again, they had to dis: ver whether the Magistrate at the prelimin- ary inquiry had power to do what he did. and whether he had sufficient evidence before him to, act in the way he did. Mr. Slade had contended that there Was a difference between the jurisdiction of a Magistrate. hearing an indictable offence, and Magistrato hearing

extradition proceedings, but Counsel urged that the Act said that he had the samo jurisdiction as he had in an indict- able, offence, and therefore his decision could not be final. He entirely disagreed with Mr. Slade that Sotto was discharged on the ground of no evidence, He was discharged on the grounds that the?
