Mr. Mackinnon, in reply, submitted that it had not been made out in fact that the beef was intended for the Russian Government. On the other point he con- tended that, as it was absolutely curtain that if the cargo went forward it would have been captured, there had been a loss within the policy, The plaintiffs, acted reasonably in taking the sten they did in selling the beef elsewhere. He referred to Butler 2. Wildmba (3 B. and Ald, 398).

Mr. Justice Pickford, after stating the nature of the action, cemmenting on tho absence of most of the documents which would throw light on the transactions entered into hy the plaintiffs, and refer- ring in detail to the cables passing between the plaintiffs' agents in San Francisco and the defendants leading up to the notice of abandonment of the cargo after a portion of it had been put on board, said the question was whether the plaintiffs were entitled to recover for a total loss, the

There were matters pointing to some such contract as that alleged by the defen- dants, but it was not necessary to decide this in view of the view he took on the last point, which was whether there had been a loss by perils insured against, That depended upon whether there was a constructive total loss at the time of the notice of abandonment. At that time the position was this: The war between Russia and Japan had broken out, the Japanese fleet was blockading Vladivo stock, and soon afterwards the Japanese captured the Korea and the optic-tho vessels carrying the plaintiffs previous shipments. His Lordship did not know the precise distance between San Fran- cisco and Vladivostock, but it was very considerable. It was anticipated that if this cargo was sent forward it would almost certainly be captured by the Japanese. Was it possible to say in these
