A Constitution is the Charter of the People's Liberties, but it is something else; it the instrument of government, for government is one of the means where by those liberties are protected. If, therefore, the Constitution does not work
smoothly is all its parts the machine will
get cut of gear and government become impossible. Still following out the train of ideas suggested in my last letter I now propose to make good the assertion that the power of veto and the right to dissolve Parliament must be vested in the Pro sident, because they are essential to a perfectly constructed machine of govern- ment; may 'n fact be likened to its brakes,

I shall first consider, the velo under English constitutional practice. Although laws are passed by King, Lorde, and Commons, the King's share is limited to assenting in the old Norman formula "Le Roy le veult," But if he may assent he may also dissent, that is, exercise the veto; for the law of the Constitution is not that he must assent. Yet so great & hold has convention obtained in England that the veto is always described as obsolete, because the power has not been exercised since the accession of the House of Hausver. I think the sounder view is that its disuse is the direct result of party government; for if a bill has been

it would indicate a conflict between the King and his Ministers; and if it has been carried by the vote of the Opposition the veto would Iny the seeds of a dispute between the King and his future Minis- ters, for the defeated Government would probably resign. This is the normal practico But new times have brought with them now Parliamentary manners; and it is conceivable that subjects may be found, like female suffrages, which shall so divide both the Government and the Opposition that rank confusion of parties will reign in the lobbies. One is therefore inevitably tempted to enquire whether the old doctrine which so depended on the maintanance of party lines still remains intact. It may be remembered that in a recent, discussion on a far more important question a whisper was heard, indignantly. hushed by the other party, that the veto might be resorted to."
Now it is no more possible in a Republic. than it is in a Monarchy to imagine legislation which is not assented to by the President; but no Constitution would provide that be muat assent. On the face of it, therefore, the power of veto should be granted to the President in China.
It will be interesting to see how the Constitutions of the two great Republics deal with the matter.
