Now I will admit that, on first reading the correspondence, one would be disposed to think that either the defendant or some of his fellow partners in P. & were also partners in F. P. That seems to be the general sanse of the lettora. But there is the defendant's own evidence to, bo can- sidered. Being an executive officer with a wide discretion in his own department. he seems to have hoon particularly averse to entering into legal technicalities. Thus, if he had desired to have an authoritative statement of the composition of the new.firmo, nothing would have been easier than to have con- sulted the defendant's legal advisors, as the defendant suggested. But Mr. Harris did not do this. On the epatrary, when Mr. Shenton applied for information he was informed that the Customs did not deal with solicitors. Mr. Harris saw the defendant Yet he never personally more than once. asked the fondant who were the partners in the new firm.
In my opinion the Commissioner cared very little about partners of partnerships. He knew that the defendat had been, in the time of the old firme, the only partner in He knew from the defendant Hongkong that he had suffered at the hands of the Borbay partners apparently through no fault of his oyn He knew the defendant to be the sole manger in Hongkong of the new firm, with sole plenary powers. The defendant says be told Mr. Harris that the new firm belonged to the same family and that part of the profits went to the support of members of the family in Bonbay. In a sense its true that this was a family firm, for the new proprietor was nearly related' to the three old partners. The defendant a partner- had an interest, though not ship interest in the business he managing. I am not inclined to put very much weight on the expressions used in the Commissioner's despatch of November 19, which was written, as Counsel pointed out, Frois Mr. Harris memory of his con- veriation with the defendant and without waiting for the defendant's reply. Then the defendant's own letter of there is November 22. The defendant told us that he went to see Mr. Deacon when he received the Commissioner's letters of November 19 and neked him to write to the Commissioner, Mr. Descon replied that it was a business mattor and that Falati had better answer the Commissioner himself.
