Deplorable Facts.

It is simply incredible that there Should still exist many educated people who cannot or will not realise that it is na absolute necessity, not only for the preservation of the teeth, but also for the general health, to take regular care of the mouth and teeth.

Just think of the fact that not millions, but milliarde cf microbes and bacteria are living in a mouth which has riot been rinsed with an antiseptic mouth- wash (Odol) Yet most people seem not to know that the destruction of the teeth is principally dne to the action of these bacteria. It is much to be regretted that this

should be so, and that a matter so vitally Important to health should not be more The family recognised. generally doctor should explain to his patients, the teacher to his pupils, and the parents to their children that it is only by the use of a liquid antiseptic (Odol) that the mouth can be kept absolutely free from bacteria. It should also be emphasised that the use of antiquated tooth-pastos and tooth-powders is ineffective and useless from a preventive point of view.

Odol most thoroughly and effectively arrests all fermentation and decompo- sition in the mouth, and produces at the same time an indescribably delightful sensation. Everyone who daily uses Odol insures the greatest protection for the teeth and mouth that science has hitherto discovered.

CHINESE GARDENER IN AUSTRALIA.

NOT A PROHIBITED IMMIGRANT,

THE HONGKONG DAILY PRESS, TUESDAY, DECEMBEE 17TH, 1912.

The Chief Justice, Mr. Justice Marray, and Mr. Acting Justice Buchanan, sitting- as the Full Court, disposed of a special case regarding un alleged prohibited immigrant who was convicted at the Port Adelaide Police Court in July last, but whose case was referred for consideration by the Supreme Judiciary. The defen- dant was Wong How, employed as a gardener, at Findon, who was arrested by Immigration Detective McSweeney, upon his failure to write down 50 words a Chinese dietated by that officer in vegetable garden.

Mr. Justice Murray; in submitting the judgment of the Court, remarked that the information had been laid under section 7 of the Federal Immigration Act, 1901, and it had been alleged that Wong How had entered the Commonwealth within two-years before his failure to pass the dictation test. It had been proved that he had been in Sydney during the years 1993 to 1900, desing odd jobs for a fellow countryman, and working as a provision He had first. been known in dealer. South Australia last January, and had sinée been at a Chinese garden at Findon, where, upon failing to pass the test, he was arrested by Detective MeSweeney, of the Customs. The immigration of certain classes of persons described as "prohibited immigrants was forbidden by section & of the Immigration Act. had not entered the Commonwealth within two years before failing to pass the test. The Court considered that mere entry into the Commonwealth was not of itself sufficient to constitute a person an immigrant, but there inust also be the intention to Beltin, or stay permanently, or for an indefinite or considerable period of time. In the present ease it was clear that Wong How must have entered the Commonwealth in or before 1903, and was not only prima facie an "immigrant at that time, but had continued in fact to be one for at least three years. If the dictation test had been put to him then or for a given period thereafter, he would thave been liable to imprisonment end deportation; but he had escaped from that liability. If, then, he had been an "immigrant" in 1903, he was not liable to be put to the dictation test in 1912, unless he had abandoned his intention of remaining in Australia, departed from the country, and returned again. It had been argued that nothing could throw upon the prosecution the onus of showing that Wong How had not entered the Commonwealth within two years before failing to as the test, except direct evidence that he had not arrived-within- That proposition clearly two years. could not be supported. The Statute did not alter the modes of proof that were open to him by the common law, but cast upon him only the burden of proof in the first instance.
