This extract, taken alone, is in conflict with a declaration on the subject made by Bis Excellency in the Legislative Council in Septembar, 1908, when Sir FREDERICK Lugand said that, like his predecessor, he inal found the general opinion to be that, except for the purposes of nu Appeal Court, a third Judge was not immediately required. That was less than four years ago, and we are not aware that it can be said that the work of the Courts has materially increased siace. It would perhaps be useful to the discussion of the question if we reproduce in its entirety Bir FREDERICK LUGARD'S reference to the subject in the Legislative Council on 24th September, 1908. We quote from Hanzard, page 126:-
