INTERESTING INSURANCE ACTION IN SIAM.

CLAIM UNDER AN INTERIM. RECEIPT.

An interesting insurance action has been tried by the International Court at Bangkok. The case was one in which the sons of Chin Thy Who claimed Tes. 12,003 from the Shanghai Life Insurance Company, representing a 10,000 dollar insurance and interest. The application for the policy was made on December 14th. The applicant was medically examined locally upon the same date and recom- mended for an ordinary policy without alien. He paid the premium for a policy (10 years endowment) in two instalments on the 26th December, 1010, and 6th January, 1911, respectively. Upon the 6th of January he was handed an interim

The interim receipt contained the following clause --" The said applicant is insured for a term of three months from date, in accordance with the conditions endorsed hereon and of the policy applied for from the Company and of the applica. tion above mentioned at the end of which time this receipt is of no value and if the policy has not already been forwarded to him the Company will return his premium on his applying for same."

The medical examiner's certificato described the applicant an` a first-class life for assurance.”

Counsel for the plaintiffs argued that so long as this interim receipt was in force, e, either for three months or until a policy had been accepted under condition 2. or declined under condition 3, tha applicant was insured for the full amount of $10,000.

The defendant said that at the time the application was made Tay Hoo well knew that he would probably get a lien policy and not one for $10,000 unconditionally. Mr. Brooks, for the defendant Company, verbal said that there was virtually a agreement between himself as local Agent and Tay Hoo to accept a lien policy, which was an acceptance on the part of the

The Court found for the plaintiffs for 810,000 and costs with interest at 5 per cent, on $5,000 up to date, 85,000 having already been paid into Court, and 7 per cent. from date of judgment until anal payment.

Judge Buzzard stated in his opinion that it was not open to the defendants to say, "It is true you are insured, but the amount payable to you is unascertained, and we keep the right to determine: the amount payable at any time until the con- tract is completed hased on the circum- stances of each case." He thought there could be no doubt that under the interim receipt the Company were liable for the full amount viz, $10,000. The policy issued was not an acceptance of the application; there was no acceptance of the policy actually issued, and therefore it was not necessary to decide the question whether there was a legal delivery of it or nut.
