ALLEGED BEEACH OF CONTRACT.

Judgment was delivered in the action by W. G. Humphreys & Co. against P. Soffietti & Co. for 8961,12, damages for breach of contract Mr. Reader Harris, of Merses. Wilkinson & Grist, appeared for the 'plaintiffs atul Hr. P. Goldring appeared for the defence.

flis Lordship dealt with the questions sat. mitted by Mr. Gol-aing. The first was- Was the contract for sale by description or sample" After considering the correspondence, his Lordship held that it was clear from the agreement that it was the intention of the partios that the contract was to be by description.

He held that the words" new orop" wers fat in originally by Mr. Sofetti and could only mean the coming crop.
